I wanted to know if It's free to get the project and change theme and make it fit my needs(not only theme), or there are restrictions(fees) if it's used in such a way?!

and welcome to our forum. 

 

A simple rule applies here:

If you're not planing to sell your modifications and only make them to use them yourself (in your own shop), you can do whatever you want with SmartStore.NET without any fees or restrictions.

What about making modifications for the shop of a customer? Or making extensions taking some parts of the code of Smartstore and selling them in other market places, different than Smartstore market place?

As Michael already stated above, you're not allowed to resell SmartStore.NET or parts of it in any way!

1) We are developers and our clients (shop owners) want some customization; so we download Smartstore and then customize it to the needs of the client; and charge for it. Is it a problem?

2) If we develop some plugins for our customizations for Smartstore; can we resell them privately or in any market place different than your marketplace?

That's not what I meant:

1. Of couse you can charge for your own professional services like customizing, support etc. You just can't sell the application to your customer as if it were yours. So, no problem!
2. Plugins should be sold in our Marketplace, but you could sell them through other channels.

What I meant in my previous post was: you're not allowed to pull out pieces of SmartStore.NET and repack them in another application for the purpose of monetization.

We are developing online stores mostly for the vertical market of clothing and accessories. Normally for each new version we do corresponding customization for the first client which are quite a lot to adapt and enhance it for the needs of the market,and then eliminate references to SmartStore such as "E-Commerce Solution by SmartStore AG © 2015". For the following clients we just make a copy of our version and some other customization to their specific needs. Is it OK?

Could someone from SmartStore please answer my question. For us, and certainly for other SmartStore users, is very important to work within the allowed limits.

that is totally ok. you just can't sell smartstore.net. but you can sell the time you spend to customize smartstore.net to your customer.

smartstore.net is free for you and must be free to your customer.
